Biroq undan foydalanish jarayonida telefonda antena chiqmasdan, aloqa tizimida  nuqsoni borligi aniqlanib, savdo markaziga almashtirish maqsadida kelgan. Lekin iste&#8217;molchining qonuniy murojaati o\u2018rganilmasdan, sotuvchi nuqsonli tovar almashtirilmasligi, balki servis markazida ta&#8217;mirlab berilishini tushuntirish berish bilan cheklangan. <\/p>\n<p>Amaldagi \u201cIste&#8217;molchilarning huquqlarini himoya qilish to\u2018g\u2018risida\u201dgi qonunning 13-moddasida nuqsonli tovar sotilganda, agar bu hol shartnoma tuzish paytida aytib o\u2018tilmagan bo\u2018lsa, iste&#8217;molchi o\u2018z xohishiga qarab nuqsonli tovarni almashtirish, tovar nuqsonlarini bepul bartaraf etish, shartnomani bekor qilib ko\u2018rilgan zararni qoplash (pulini qaytarib olish) va boshqa shu kabi talablarini qo\u2018ya oladi. Ushbu talablarni iste&#8217;molchi sotuvchiga qo\u2018yadi. <\/p>\n<p>Biroq qonunning 16-moddasida ko\u2018rsatib o\u2018tilganki, agar sotuvchi iste&#8217;molchining tovarni almashtirib berish yoki undagi nuqsonlarni bartaraf etish haqidagi talablarini bajarmagan bo\u2018lsa, iste&#8217;molchi tovarning xarid narxini nuqsonga mutanosib ravishda kamaytirishni yoki shartnomani bekor qilib yetkazilgan ziyon va ma&#8217;naviy zararni ushbu Qonunning 20 va 22-moddalariga muvofiq qoplashni talab qilishga haqli.<\/p>\n<p>Murojaatni o\u2018rganish ishlari davomida sotuvchiga yuqoridagi holatlar tushuntirildi. Tovar uchun naqd pulda to\u2018langanligi, oldi-sotdi amalga oshirilgach iste&#8217;molchiga kassa cheki berilganligi, kafillikni bildiruvchi kafolat talonlarini lozim darajada to\u2018ldirib berilganligi kabi holatlar inobatga olindi. Natija esa ishni iste&#8217;molchi foydasiga hal etilishi bilan yakun topdi.<\/p>\n<p>&#8212;<em>Bag\u2018dod tuman xalq qabulxonasi meni murojaatimni o\u2018rganish ishlariga tuman iste&#8217;molchilar huquqlarini himoya qilish jamiyati mutaxassislarini jalb etishdi.
