buzilganligi uchun ushlangan transport vositalarini saqlash xizmatlari ko\u2018rsatish bo\u2018yicha faoliyatni amalga oshiruvchi xo\u2018jalik yurituvchi subyektlarda Vazirlar Mahkamasining 25.05.2011 yildagi 149-son qarori bilan tasdiqlangan \u201cQonun hujjatlari buzilganligi uchun ushlangan transport vositalarini saqlash xizmatlari ko\u2018rsatish bo\u2018yicha faoliyatni amalga 300px\" \/><\/p>\n<p>Ma\u2019lumki, O\u2018zbekiston Respublikasining \u201cIste\u2019molchilarning huquqlarini himoya qilish to\u2018g\u2018risida\u201dgi qonuni 9-moddasiga ko\u2018ra, ayrim turdagi tovarlarni (ishlarni, xizmatlarni) realizatsiya qilish qoidalari O\u2018zbekiston Respublikasi Hukumati tomonidan tasdiqlanadi. Vazirlar Mahkamasining 25.05.2011 yildagi 149-son qarori bilan tasdiqlangan \u201cQonun hujjatlari buzilganligi uchun ushlangan transport vositalarini saqlash xizmatlari ko\u2018rsatish bo\u2018yicha faoliyatni amalga oshirish tartibi to\u2018g\u2018risidagi nizom\u201d (qarorga 3-ilova), yuridik shaxslar tomonidan qonun hujjatlari buzilganligi uchun ushlangan transport vositalarini saqlash xizmatlari ko\u2018rsatish bo\u2018yicha faoliyatni belgilangan tartibda amalga oshirish tartibini belgilaydi. Bundan ko\u2018rinadiki, ushbu sohada faoliyat olib boruvchi xo\u2018jalik yurituvchi subyektlar o\u2018z faoliyatlarini mazkur Nizomda belgilab berilgan tartibda amalga oshirishlari lozim.<\/p>\n<p>O\u2018rganish davomida Farg\u2018ona viloyatining 14 ta ma\u2019muriy-hududiy birligida ushbu faoliyatni amalga oshiruvchi 18 ta xo\u2018jalik yurituvchi subyektlar faoliyati bilan tanishilganda, yuqoridagi Nizom talablarini to\u2018laqonli ijrosi ta\u2019minlanmaganligi holatlariga ham duch kelindi.<\/p>\n<p>O\u2018rganilgan 18 ta subyekt bo\u2018yicha transport vositalarini saqlash nazarda tutilgan jami to\u2018xtash joylari soni 3 490 ta bo\u2018lib, shularning 1 935 tasi usti yopiq holatda saqlashga, 1 166 tasi esa to\u2018liq ochiq osmon ostida saqlashga mo\u2018ljallangan bo\u2018lib, shulardan 7 ta subyektda avtotransport vositalarini usti yopiq bino (inshoot) ostida saqlash uchun sharoitlar qilinmagan va ular to\u2018liq ochiq osmon ostida saqlanadi.<\/p>\n<p>Nizomning 5-bandida, transport vositalarini saqlash joylari transport vositalarini saqlash uchun mo\u2018ljallangan to\u2018xtash joylarini joylashtirish va jihozlashga qo\u2018yiladigan texnik shartlar talablariga, shu jumladan boshqa bir qator talablarga javob berishi kerak. Ya\u2019ni bu joylar hududi qattiq qoplama bilan qoplanishi, kuzatuv kameralari, yoritish, axlat to\u2018plash uchun konteynerlar, suvni tindiradigan yomg\u2018ir kanalizatsiyasi, yong\u2018inga qarshi vositalar mavjud bo\u2018lishi lozim.<\/p>\n<p>O\u2018rganishda 18 ta subyektlarning 9 tasida xo\u2018jalik yurituvchi subyektning avtomobillarni saqlash uchun mo\u2018ljallangan hududi yo qattiq qoplama bilan to\u2018liq qoplanmaganligi yoki umuman qoplanmaganligi kuzatildi. Subyektlarning 5 tasida axlat to\u2018plash uchun konteynerlar, 9 tasi hududida suvni tindiradigan yomg\u2018ir kanalizatsiyasi mavjud emas. Ularning 4 tasida yong\u2018inga qarshi vositalar to\u2018liq shakllantirilmagan, 2 tasida esa umuman mavjud emas yoki o\u2018rganish kunida ko\u2018rsatib berilmagan.<\/p>\n<p>Nizomga ko\u2018ra, hudud 2 metrdan past bo\u2018lmagan temir-beton (metall, g\u2018isht, shlakoblok) devor bilan o\u2018ralgan bo\u2018lishi lozim bo\u2018lib, o\u2018rganilgan subyektlarning 3 tasida ushbu devorlarning balandligi talab darajasida emasligi yoki to\u2018liq o\u2018ralmaganligi qayd qilindi.<\/p>\n<p>Nizom talablarida kirish (chiqish) darvozlarining kengligi kamida 4,5 metr bo\u2018lishi lozimligi belgilab qo\u2018yilgan bo\u2018lsada, subyektlarning 6 tasida ular ushbu normadan kam bo\u2018lib, 3 metrdan 4,25 metrgachani tashkil qilishi kuzatildi.<\/p>\n<p>Tartib-qoidalarga ko\u2018ra, nazoratchi kassirning xonasi kirish (chiqish) uchun ajratilgan joyga tutashgan bo\u2018lishi kerakligi ko\u2018rsatib o\u2018tilgan bo\u2018lib, 3 ta hududdagi subyektlarda ular kirish (chiqish) joyidan boshqa joyda joylashganligi, kirish (chiqish) joyining nazoratchi kassir xonasi tashqi qismiga ko\u2018rinarli joyida ushlangan transport vositalarini saqlash xizmatlari ko\u2018rsatishning tariflari va shartlari to\u2018g\u2018risida yirik harflarda ma\u2019lumot joylashtirilishi to\u2018g\u2018risidagi qoidaga 4 ta subyektlarda amal qilinmaganligi qayd qilindi.<\/p>\n<p>Qonunlarda xizmat ko\u2018rsatish joylarida nogironligi bo\u2018lgan shaxslar uchun belgilangan hajmlarda alohida sharoitlar tashkil qilinishi lozim bo\u2018lib, Nizomda ham ushbu talab nazarda tutilgan va bunday shaxslar uchun kamida ikkita to\u2018xtash joyi mavjud bo\u2018lishi lozim bo\u2018lsada, o\u2018rganilgan subyektlarning 7 tasida nogironligi bo\u2018lgan shaxslar uchun maxsus jixozlangan to\u2018xtash joylari tashkil qilinmaganligi kuzatildi.<\/p>\n<p>Nizom talablariga ko\u2018ra, bitta transport vositasining to\u2018xtash joyi uchun hisoblangan maydon 20 kv metrga teng deb qabul qilinishi belgilangan bo\u2018lib, 10 ta subyektlarda to\u2018xtash joyi uchun hisoblangan maydon ushbu normadan kam, 18 kv metrgacha va undan ham kam qilib olinishi holatlariga duch kelindi.<\/p>\n<p>O\u2018rganilgan subyektlarning 6 tasida alohida telefon aloqasi bo\u2018lsada, ichki ishlar organlari naryadlarini tez chaqirish knopkasi bilan ta\u2019minlanmaganligi, ularning 5 tasi esa har ikkisi bilan ham ta\u2019minlanmaganligi kuzatildi.<\/p>\n<p>Shuningdek, o\u2018rganish davomida to\u2018xtash joyida hududga begona shaxslarni qo\u2018yish, transport vositalarini ularni joylashtirish rejasini buzgan holda to\u2018xtash joylarining hisoblangan sonidan ortiqcha qabul qilish va joylashtirish, transport vositalari o\u2018rtasidagi masofani kamaytirish kabi Nizomda taqiqlangan holatlarga duch kelindi.<\/p>\n<p>Shuning bilan birgalikda, 5 ta subyektda aholi bilan pulli hisob-kitoblarni amalga oshirish uchun bo\u2018lishi shart bo\u2018lgan Nazorat kassa mashinasi va to\u2018lov terminalining mavjud emasligi, 9 ta subyektlarda Nizomning 8-bandida transport vositalarini saqlash bo\u2018yicha ko\u2018rsatiladigan xizmatlar, shuningdek ularni tashish (evakuatsiya qilish) xarajatlari uchun haq to\u2018lash ko\u2018rsatilgan xizmatlarni ko\u2018rsatuvchi yuridik shaxs tomonidan tasdiqlangan, biroq O\u2018zbekiston Respublikasi Moliya vazirligi bilan kelishgan holda Qoraqalpog\u2018iston Respublikasi Vazirlar Kengashi, viloyatlar va Toshkent shahar hokimliklari tomonidan belgilanadigan cheklangan miqdorlardan yuqori bo\u2018lmagan tariflar bo\u2018yicha amalga oshirilayotganligi bildiruvchi preskurantlarni aholi (iste\u2019molchilar) e\u2019tiboriga yetkazilmaganligi holatlari ham kuzatildi.<\/p>\n<p>O\u2018tkazilgan jamoatchilik monitoringi yakunlari bo\u2018yicha jamlama ma\u2019lumotnoma Farg\u2018ona viloyat IIB YHXBga vakolati doirasida tegishli chora-tadbirlarni belgilanishi uchun
